1. General Terms
- All drawings will include a signature that you may not remove.
- I may record and post the drawing process.
- Prices are subject to change (this will not affect you if you've already paid, of course)
- I have the right to reject a request for any reason.
2. Payment
- Commissions are to be paid in USD.
- I recommend not using your PayPal account to pay the invoice. Please use a debit or credit card instead so I do not see your full name.
- Commissions are paid 100% upfront.
- If I cannot complete the commission for any reason you will be refunded the full amount (minus platform fees).
3. Process and Delivery
- While I'm working on your commission, I will make reviews with you to make sure I get it looking the way you want. Feel free to request any changes you'd like (within reason- don't change the whole piece.)
- It may take anywhere from a day to 2 weeks to complete your commission depending on various factors such as school, my physical and mental health, and the complexity of the piece.
- If anything comes up that will slow progress I will let you know as soon as possible.
- Once the piece is finished, you will receive a full resolution image as long as a web-friendly size. Note that there is no physical product.
4. Copyright / Usage Policy
I, Grimnott (the artist) claim the rights to the produced drawing, not the buyer. Therefore I am allowed to use the copyrighted artwork to:
- Post it online
- Use for self-promotion (commission example sheets, etc)
- Publish it in books (such as artbooks)
- Display it on my website and social media
While I still hold the rights to do so, if you request the artwork not be posted, I will comply.
The buyer is allowed to:
- Use the commissioned piece for personal use unless agreed otherwise (You can upload it on all your social medias, forums, etc)
- Print the artwork and claim the character(s) as their own (given that they own the rights to the characters), but not the artwork itself.
- Use the artwork to promote themselves. You are not forced to credit me when you post it, but it is appreciated.
- Use the artwork on their youtube channel and in monetized videos as long as the artwork itself is not the main subject for the earnings.
The following is considered copyright infringement:
- Reproducing/using the copyrighted artwork commercially. This includes (but is not limited to) selling the artwork on merchandise such as stickers or clothing, and selling the artwork as a NFT (Non-Fungible Token).
- Claiming you created the artwork.
- Removing my signature.
- Altering the artwork without my knowledge and consent (Especially in ways that go against my TOS and boundaries stated on commission pages).
- Knowingly adding the artwork to any generative AI training dataset. Do not put the artwork into any sort of AI tool.
Any other form of for-profit redistribution not mentioned above is also considered copyright infringement, unless I have given you explicit permission to use the artwork for some commercial purposes.
If you intend to use the artwork for commercial purposes this must be stated upfront so you can pay appropriately. Otherwise all above terms apply.
5. Customer Satisfaction
I will do anything I can to make my customers happy. As such, if you have an issue with anything in regards to the commissioned piece, please let me know so I can make the alterations as early on in the process as possible.
I am willing to change some terms for you if you ask before I start your commission. As stated above, I will not post the piece online if requested, and other terms are subject to change.
If the buyer breaks any of the points stated above they will lose all the aforementioned rights to the commissioned artwork, and I (the artist) will have the right to profit further from the commissioned artwork in any way I see fit. Severe breaches of copyright may be subject to legal action.
